Will this work as bathtub overflow tube?

For best results, we recommend you use InSinkErator accessories with InSinkErator units. This is designed to provide a quick way of connecting the disposer discharge to the drain line.

Will this pass a home inspection? I understand this does not meet the plumbing code.

I do not see any reason why it would not pass

aren't you supposed to use a p trap ? or not?

Yes, this should be connected to a p-trap.
