Should the double nut on the axle be tightened against the wheel hub?

I'd say yes. For the trailer I received the wheel axles are just as wide as the spacing between the mounting brackets welded onto the frame of the cart. The brackets should be spaced closer together so that the insides of these brackets easily align with the 2 sets of double nuts. As it came spaced wider ( in my opinion way too wide) between the brackets makes it difficult to attach the conical nut and align the washer with the bent tab onto the end of the skewer which makes it more difficult to remove a tire to repair a flat. You have to over tighten the skewer nut and bow in the outside tubing in order to get the brackets to contact the nuts. This is likely to angle the brackets and make them no longer parallel, which is yet another problem. I decided to compromise and add 2-3 washers on each side between the double nuts and the insides of the brackets. I'll also likely bend/bow the outer tubing so the end tips of the axles extend a little beyond the outside edges of the axle mounting brackets. This is a very poor design or they substituted a wheel with a smaller axle length. Without firmly contacting the side brackets you're just relying upon the spring tension of the tubing being bowed in to hold the wheels on....not on my trailer.

My scooter rack shaft has no room vertically. Can the clamp be turned sideways to attach to my rack behind the seat?

Yes you should be able to if you modify it to for your scooter however that being said please look up local/state laws might not be legal in your state. I wouldn't go no 50mph with it but a 25 to 35mph cruise speed should be fine have seen these on e-bikes and mini bikes and they go around that speed.

How long is the horizontal part of the arm that connects to the seat post? Distance from the seat post connection to where the arm bends down?

It is 21 inches to the first bend.
