Can the pans be used on induction surface?

Yes it can used on induction surface. I used on same surface and didn't find anything wrong.

The handle on the small lid came laid down. Is it broken? Is there a catch to how I get it to stay up like the other two.

The handle is not broken. The set is a nesting ( stacking) set. The handle on the little one lays flat for storage and it will stand up kind of leaning to one side. It is easy to remove when cooking though.
